A capital market institution plans a temporary suspension of securities business for a foreseeable reason. What is the minimum written notice to the Authority?
45 days before cessation Article 12(a)(1) requires at least 45 days’ advance notice. [Capital Market Institutions Regulations, Article 12(a)(1); amended 7 January 2026.]
An institution prepares an email inviting one person to invest in securities before sending it. How is it classified?
A prepared securities advertisement Prior preparation and an invitation to securities activity meet the definition even for one recipient. [Capital Market Institutions Regulations, Article 33(a); amended 7 January 2026.]
An institution wants to transfer client money to a settlement party for a securities transaction through that party. Does Article 71(e) prohibit this simply because the recipient is not the client-account bank?
No; it permits transfer for settlement. Article 71(e) permits transfer to another person to settle a securities transaction with or through that person, or provide client collateral. [Capital Market Institutions Regulations, Article 71(e), current text.]
The institution held client assets during the year, then the balance became zero; the account is not closed and no closing statement was sent. Is an annual client statement required?
Yes, assets were held during the year and the closure exception is unmet Article 91(b) covers holding at any time during the year even with no holdings on statement date. [Capital Market Institutions Regulations, Article 91(b)(c); amended 7 January 2026.]
A client’s overseas dividend reaches an overseas bank account in the institution’s name, without a settlement need. The institution is notified of receipt today. Which action satisfies the special overseas-income exception?
Transfer to a client account or pay the client within three days. Article 73(d) permits this receipt of overseas dividends or income if transferred to a client account or paid to the client within three days after receipt notification; other applicable requirements remain. [Capital Market Institutions Regulations, Article 73(d)–(e); amended 7 January 2026.]
A client statement combines all shares into a single total, although some are registered in the client’s name and others lawfully in another name. What distinction must the statement show?
Client-name registrations separately from other-name registrations. Article 91(d)(1) requires separate identification of securities registered in the client’s name and in another name; lawful alternative registration does not remove this disclosure. [Capital Market Institutions Regulations, Article 91(d)(1); amended 7 January 2026.]
