Study material sample: Introduction to the study of law

Summary

About 2 of the 50 exam questions (3% to 5%) come from this unit, usually short definition questions. It has two sections. The first covers the concept of law and the features and divisions of legal rules: mandatory and supplementary rules, and public and private law. The second covers the sources of law, its scope in time and place and its branches, then how laws are issued in Saudi Arabia: under Article 70 of the Basic Law of Governance, laws are issued and amended by royal decree, and under Article 71 they are published in the Official Gazette and take effect from the date of publication unless another date is stated.

What the exam focuses on

  • A legal rule has three features: it is general and abstract, it is social (it governs people's conduct in society), and it is binding, backed by a sanction imposed by public authority.
  • Parties may not agree to depart from a mandatory rule; a supplementary (interpretive) rule applies when the parties are silent and they may agree otherwise.
  • Public law governs the state acting as a sovereign authority; private law governs relations between individuals and between the state and individuals when the state acts as an ordinary person.
Show 3 more
  • Article 70 of the Basic Law of Governance: laws are issued and amended by royal decree, as are treaties, international agreements and concessions.
  • Article 71: laws are published in the Official Gazette and take effect from the date of publication unless another date is stated.
  • Article 7 of the Basic Law: the Quran and the Sunnah govern the Basic Law and all state laws; Article 67 requires the regulatory authority to make laws and regulations in line with Sharia rules.

Common traps

  • Mixing up mandatory and supplementary rules: what concerns public order and morals is mandatory, and what is left to the parties' will is supplementary.
  • Confusing a legal rule with a moral rule: the legal rule has a material sanction imposed by public authority, while the moral rule has only a moral sanction.
  • Mixing up Articles 70 and 71: the first says who issues and amends a law (royal decree); the second deals with publication and entry into force.
Show 3 more
  • Confusing a law with its regulation: the regulation is issued to implement the law and detail its provisions, and it may not contradict the law.
  • A relationship is classified by the capacity in which the state acts, not by the fact that the state is a party: when the state contracts as an ordinary person, for example by buying or leasing, private law applies.
  • A law generally applies to what happens after it takes effect and applies to the past only by express provision; it is a mistake to tie entry into force to the date of the decree rather than the date of publication.
